Terms of Service

1. Acceptance

By accessing or using Mudkeep ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Rinquist Holdings LLC ("we", "us", "our").

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Distribute malware, spam, or other harmful content.
  • Infringe the intellectual property rights of others.
  • Harass, threaten, or harm other users.
  • Attempt to gain unauthorized access to any systems or networks.
  • Host content that is illegal, obscene, or violates the rights of third parties.

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

5. Subscriptions and Billing

The Service is offered on a subscription basis. Fees are charged in advance on a monthly basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your instance.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We are not liable for any downtime, data loss, or damages resulting from service interruptions.

7. Backups

We provide automated backups as part of the Service. However, you are solely responsible for maintaining your own copies of critical data. We are not liable for any loss of data.

8. Intellectual Property

You retain ownership of all content you upload or create using the Service. By using the Service, you grant us a limited license to host and transmit your content as necessary to provide the Service. Mudkeep and its logos are trademarks of Rinquist Holdings LLC.

9. Termination

Either party may terminate these Terms at any time. Upon termination, your access to the Service will cease and your instance and data may be deleted after a reasonable notice period. We reserve the right to terminate accounts for violations of these Terms immediately and without notice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RINQUIST HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

We respect intellectual property rights. If you believe content hosted on the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent:

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.
